Union-Rights Poster Deadline Postponed by NLRB

EMPLOYER COMPLIANCE ALERT!!!

The National Labor Relations Board (NLRB) has announced that the implementation date for the new poster dictating employee rights to join a union has been postponed until January 31, 2012. Many businesses were uncertain about where they would fall under the Board's jurisdiction, so the deadline was postponed. Whether you are unionized or not, almost all private-sector workplaces will be required to display the "Employee Rights Under the National Labor Relations Act" poster.

Common applicable standards are:

  • Organizations that exclusively use independent contractors, not employees
  • Retail organizations with annual gross volume of business below $500,000
  • Nonretail organizations with less than $50,000 in goods or services provided by the employer out of state or purchased by the employer from our of state
  • Organizations that fall below specific industry-based thresholds for gross annual volume
Employers can expect to receive further insight into the poster requirement from the NLRB until the end of January.
